Settlement Conference Clerk – Default Services

Summary
The purpose of the Settlement Conference Department is to facilitate the loss mitigation process within the context of a foreclosure action. The primary objective is to assist with gathering documentation and communicating with the borrower or his/her counsel in order to assist with rendering a determination regarding whether there is home retention options available to a borrower in order to forego the foreclosure process. The Settlement Conference Department is responsible for calendaring of conferences, gathering documents, preparing files for the appearing attorney, and scheduling appearing attorneys. Additional duties as assigned by the supervisor and team lead at any given time.

Education: Associates Degree and/or High School Diploma with commensurate administrative work experience.

Required Knowledge and Experience: Applicants must be proficient in Microsoft Office Programs, including Windows, Word, Excel, Outlook, as well as Adobe or PDFDocs. Document Management software experience is also preferred. General knowledge of the foreclosure process a plus. Knowledge of NY foreclosure mediations process. Experience preparing mediation loans for upcoming appearances. Experience in processing appearance results.

Core Competencies: Dependability, attention to detail, good spelling, ability to meet deadlines in a fast paced environment, excellent verbal and written communication skills, ability to produce a professional work-product with minimal errors, ability to work independently, with little or no direction, to multi-task, prioritize and problem-solve, strong interpersonal skills, ability to work in a team environment, and good time management skills.

Physical Requirements: Although a mainly sedentary position, applicants must have the ability to carry files, bend and stand for extended periods of time.


Motions Clerk – Default Services

Summary
The purposes of the Motions Clerk is to petition the court to issue an order lifting the Automatic Stay to the extent necessary to allow the Secured Creditor to commence or proceed with foreclosure. This is requested when the Debtor fails to make post-petition payments in a Chapter 13 or 11 or is delinquent in contractual payments in a Chapter 7.

The Motions Clerk is responsible for all Motions for Relief, Conditional/Agreed Orders and Notice of Defaults. In addition, to processing Relief Orders from the court to allow files to enter the next stage of the default process. Furthermore, the Clerk is responsible for identifying any court deadlines or future appearances and ensuring the case management system is properly updated.
